Navigating Property Settlement During Peak Seasons in Western Australia

Trying to line up your property settlement with a new year fresh start? You’re not alone. In Perth, property activity often increases during popular selling periods, which can place extra pressure on property settlement services later on. When banks are busy, offices slow down over Christmas and New Year, and key service providers are stretched, even straightforward property settlements can feel more stressful than expected.

For buyers and sellers alike, Australia’s peak periods in the Spring and Summer months can mean tighter timelines, slower responses, and less flexibility if something unexpected comes up. Finally, start gathering your paperwork early. Creating a simple step-by-step checklist or document folder can help you track what’s been completed and what’s still outstanding. PEXA is an electronic conveyancing platform that allows many key settlement tasks to be completed digitally, reducing paperwork and improving efficiency.

Through PEXA, settlement agents can manage tasks such as:

  • Document lodgement and signing, including Transfers of Land and other required documents, using secure digital signatures
  • Financial settlement, with funds transferred electronically rather than exchanged in person

Your settlement agent will guide you through what is handled electronically between settlement agents, financiers, solicitors and inspectors and let you know what information or approvals are required from you and by when.

Book inspections and moving arrangements in advance

Buyers should also be aware that, under WA Consumer Protection guidelines and the General Conditions, buyers may have the opportunity to conduct a final inspection within 5 business days prior to settlement or taking possession. If entitled to one, this inspection allows you to confirm that the property is in the same condition as when the Offer and Acceptance contract was signed and that any agreed items remain in place.

Understand deadlines and requirements

In Western Australia, settlement periods commonly range from 30 to 90 days, depending on the terms of the contract. Settlement occurs when the balance of the purchase price is paid and legal ownership of the property is transferred.

If the property settlement does not occur on the agreed date, penalty interest may apply, so it’s important to choose a timeframe that is achievable for all parties during the peak periods. WA Consumer Protection recommends allowing sufficient time, particularly where finance approval or special conditions are involved.

As a general guide, a settlement date around 28 days after finance approval or after the contract becomes unconditional can help provide a workable buffer, especially during peak periods.

It’s also important to understand settlement adjustments. Costs such as council rates and water charges are usually adjusted so the seller pays up to and including the day of settlement, and the buyer is responsible from the day after settlement.  Your settlement agent will handle the adjustment of these rates.
